Rental Agreement Last Revised: May 01, 2011 Hi and welcome to Beach1 Cottages. We hope you have a wonderful stay! Please read the following guidelines and fill out the necessary information required for your vacation. If you have any questions, please do not hesitate to contact us and we will be more than happy to help you. Cleanliness During your stay with Beach1 Cottages, please ensure a clean environment both inside and out. We ask that you treat the cottage and property with respect and as you would your own home. The cottage is to be in relatively the same condition for checkout as it was when you checked in. All dishes must be cleaned and put away as they were when you arrived. All beds are to be made, do not strip them. All towels are to be placed in the hamper(s) provided. Personal belongings are to be removed from the cottage. Yard must be near free of bottle caps, cans, glass, wrappers, paper, food, cigarette butts and other garbage/recyclable materials. Garbage & Recycling Your cottage has garbage and recycling bins. Please separate recycling from garbage to the best of your ability. If you feel the bins provided to you are nearing full, please contact us, and we will have this taken care of for you by the next morning. The owners of your property have to pay to have all garbage & recycling removed, separated, and disposed of properly. Not only does it cost us money, but it is good for the environment. Please help so please recycle responsibly. Do not leave garbage bags outside on the property. Cottage areas have various animals that may cause an even bigger mess if left overnight. Smoking There is absolutely no smoking in any of the cottages we own. We prohibit smoking for the health and consideration of our guests, and respect for the property. Smoking in any of the cottages will result in a full loss of the security deposit with possible eviction. Also please refrain from throwing cigarette butts on the driveway, yard or garden beds. Smoking includes illegal drugs of any kind. Illegal drugs are not permitted in the cottage or on the property. Guests Age & Parental Consent Guests of Beach1 must be over 18 years of age. Parental consent must be given prior to check in if anyone is under age. At Beach1 Cottages we prohibit under-age drinking in the cottages and on the property. If we are made of aware of under-age drinking, our staff can order an immediate eviction of the premises, without refund and your security deposit will be forfeited. Underage drinking is against the law, and we take this very seriously. *************** VERY IMPORTANT ****************** Noise / Disruption This is the issue we take the most serious and have zero tolerance for. Wasaga Beach Bi-Law states all residents must refrain from any excessive noise at any time during the day and we trust you will abide by this. Please respect the guests in the other Beach1 Cottages as well as surrounding neighbors. We take noise complaints very seriously, as we uphold a stellar reputation in the area. Wasaga Beach is a fun and enjoyable place to be from visitors all around the world. All we ask is that you conduct yourselves in a way that is not disrupting to other people nearby. Please note that if the police or bi-law officers are involved in any way due to an incident with your cottage, you can be asked to vacate your belongings from the property, and you will not receive a refund of your deposit or the rental amount for the cottage. Our properties are here to have a fun time, but they are not to be treated like frat houses. We promote responsible fun. Fines from the city can exceed $25,000.00 and the loss of an operating license, which is why we don’t take this lightly. Please consider this as your first and only warning. We have never had to remove someone from the property in the past and we are confident this will be the case for a long time to come. ************************************************* Respect Other Beach1 Cottages Guests and Neighbors. We expect all cottagers to get along with your neighbors and refrain from any type of arguments or misunderstandings. If you have any concerns please contact Aaron Armstrong right away. Everyone is looking to have a good time during their stay. Please do what you can to ensure a respectful, fun atmosphere for everyone. Visitors on our properties. We ask that you refrain from bringing anyone on the property that is not a registered guest with Beach1.com. You are responsible for lost, stolen or damaged property. If you have a problem with an unwanted visitor, please call Aaron Armstrong immediately. Vehicles and Parking There are plenty of parking spots for all of our guests. If you are staying at 28 River Avenue, please ensure most of your vehicles are parked on the left hand side of the driveway. Please keep a lane clear from cottage#2 to the road, to allow for everyone to pull in and out in an orderly fashion. Supplies & Linen Bedding, pillows, towels, cutlery, dishes, and various other kitchen utensils have been provided for your convenience. Each week we update the inventory control sheet prior to your check in. If there are any items that are lost or broken, you will be responsible for the items. We do provide toiletries but only what is available to you when you book in. When you run out, it is your responsibility to cover what is needed for the remainder of your stay. Check In & Out Check out is 10:00 AM on the final day of your booking unless a prior arrangement has been made on your booking. Please note that a member of our staff may not be available at the time you check out. In this case, simply leave the keys, and guest satisfaction form on the kitchen table inside the cottage, and lock the door behind you and a member of our staff will do an inspection of the cottage as soon as possible. CedarLane is the exception. Please contact us if you plan on checking out earlier than expected. Security Deposits & Refunds A security deposit is required to book with Beach1 Cottages. This security deposit also acts as a damage, replacement, key, and cleanup deposit. Upon checkout you are entitled to a full refund of this security deposit provided the rules and guidelines of this agreement have been followed and there are no missing or damaged items. Security Deposits will be either: A) Mailed out to the registered address of the Primary Guest via courier. UPS, Fedex, DHL and Canada Post are all accredited couriers that may used to transport your deposit back to you. B) Sent directly to you via E-Transfer to the email address we have kept in contact with you. The security word for all of our EMT deposit refunds is lowercase: beach1. A follow-up email will also be sent out underlining that a deposit has been sent to you. If there are any issues, please contact us and we will be happy to address them at once. All security deposits will be sent within 7 business days if entitled. It is at the full discretion of the Beach1 Cottages owner or management team as to whether the full security deposit should or should not be refunded back to you. An email and a follow-up call will be sent out to the Primary Guests registered email address underlining any deductions in deposit (If any). Here at Beach1 we want you to return. We don't want a situation where deductions from security deposits have to be made. We value your business, friendship, and loyalty. That being said, we are a small, family run-operation and we work hard to provide you with the best cottages in the entire area. We just ask that you do your part during your stay to make it enjoyable for the next people that arrive, just as they did for you. Children and adults cause accidents. If something is damaged simply call us right away. We are very understanding and we will work to replace or repair the damaged item. Honesty really is the best policy. Keys Each cottage is given a set of 1-2 Keys for use during your stay. Please keep in mind that in the event a key is lost, a deduction (noted below) will be made from your security deposit. This is for our security, as we have to change the locks and produce new sets of keys for it. Please do not lose your keys. Amenities We want all your amenities such as BBQ, TV, Satellite, DVD Player, Wireless Internet as well as others to work the entire duration of your stay without interruption. BBQ - You have been provided with a fully functional propane BBQ. We would like for you to use them for your cooking enjoyment, however they are very expensive units, and require the utmost care. Please thoroughly clean the BBQ's after each meal. Do not put firewood, charcoal, or any other foreign objects into the BBQ. Doing so will damage the BBQ. Propane is not included with the BBQ. If you have propane in your tank, it is because the guests before you have been kind enough to pay for the tank to be filled. If you require propane we can deduct $25.00 off of your deposit and have one delivered promptly. Internet - High Speed Wireless Internet is available for all of our guests. When scanning for networks you will see the "Beach1_Cottages" Network. Please contact Aaron Armstrong for the password to allow you to connect. Please refrain from downloading massive files such as torrents. We promote light use for your enjoyment, but we do have bandwidth caps from our provider. If you require a larger than normal download or heavy use, simply contact us to have that cleared. TV/Satellite/DVD We provide you with Bell Satellite TV Service. If you require any assistance with the receiver, TV, or controls, please contact us for assistance. If there is a Pay Per View Program you wish to view, such as a Sporting Event, or Movie, please contact us and you can pay for the event to be unlocked. Fires/Fire Pit Areas Cottage #1 and #3 have their own fire pit area. Cottage #1's fire pit area is located on the left side of the property, and cottage #3 on the right side of the property (facing the river). Your fire pit area comes with a mesh, ball-shaped fire pit, which is enclosed with a screen. Please keep this screen closed at all times. Wasaga Beach Bi-law prohibits fire flames being more than 0.5 meters in height. Wasaga Beach Bi-Law prohibits fires from being lit in any circumstance after 1:00AM. Firewood is provided once during your stay. We are limited to the firewood we have for all the cottages we support, so please try to conserve it as much as you can. Extra firewood is your responsibility. You can call us to have firewood dropped off to you from a 3rd party company, but there is a charge for this, and we do require 24 hours notice. Firewood will be dropped off into the large wooden crates located on the property. Additional / Unauthorized Guests At Beach1.com there are no trespassers allowed on the property. We do understand the social aspect of coming to Wasaga Beach. If you would like to have a guest on the property that is not registered with beach1.com, please contact us to have this arranged. Understand that if you choose to bring an unregistered guest on the property, we will not be held responsible for lost/stolen/damaged items. If an unauthorized guest is found to be using the cottages without the consent of beach1.com staff, you may be subject to a deduction of your security deposit. Lost & Found At Beach1 Cottages, we provide keys to the cottages for your security. Keep in mind, that during your stay Beach1 Cottages will not enter any of the cottages without first attempting contact with the Primary or Secondary Registered Guest. Because we cannot control who enters or exits the premises during your stay, we will not be held liable or responsible for any lost, stolen, or damaged personal belongings. We will however, do everything in our power to have any lost items returned back to you after you check out if they are found. If you feel you have lost a particular item of value, we please ask that you contact us so it can be documented. If the lost item is found by any of our staff, we will be more than happy to return it to you in the same condition it was found in. Dock – 28 River Avenue Crescent The dock is provided for both relaxing, and docking your boat. Please ensure you only dock one boat for Cottage # 1, and Cottage # 3. Unless no other boats have been checked in, or there is space available, Cottage # 2 may take a docking spot. Please check with us before launching your watercraft. If anyone is found abusing the dock, such as lighting fireworks, roughhousing, or any other general mis-use, we reserve the right to withhold the entire security deposit to cover damages. Pool, Sauna & Hot Tub (CedarLane only) CedarLane is a beautiful property and which has plenty of amenities to help you relax and have fun. Understand that the use of these amenities is at your own risk. If you require assistance in operating any of these amenities, please contact us and we will be more than happy to help. Please make sure that everything is properly shut off and cleaned after each use. This not only helps for sanitary reasons, but ensures they last for a long time as well. Safety & Precautions While staying with Beach1 Cottages, you have access to a beautiful view of the beach, a riverfront setting or a Poolside Oasis. Please be sure to exercise complete caution when near the river or the pool. If you are drinking, please do not go near the waters edge, as it can be very dangerous. The dock at 28 River Avenue near the water’s edge is available for your enjoyment; please do not swim in the river. There are strong undertows and high watercraft traffic which can prove to be fatal. There is a shallow entry beach only a short walk away from all of our properties which is perfect for swimming. Each cottage comes equipped with a fully functioning fire extinguisher, located on the wall in the main hallway/kitchen area. In the event of a possible fire, please use the fire extinguisher right away and contact us. Each cottage is also equipped with smoke alarms and/or carbon monoxide detectors and have been fully inspected by our local fire departments. *******IMPORTANT******** Beach1 Cottages and its staff will not be held responsible for personal injury on or off the property during your stay, OR entering/exiting the property before or after you have checked out. We will also not be held responsible for sickness, illness, or any other health related problems or injury directly or indirectly resulting from consumption or use of the Cottage contents or contents found on the Cottage property. By signing this agreement, the primary guest releases Beach1.com and its staff of any and all claims, and takes responsibility for all damage or loss caused by any of the guests on the property during the time of their stay. ************************* In the event of an emergency, call 911 and be sure to contact us immediately after everyone is safe. We rarely have had to keep any part of anyone’s deposit, and we hope to keep it that way. By signing this document you are agreeing that you have shown your guests, they have read in full and will abide by the terms set forth in this Agreement. This agreement can also be found on www.beach1.com/about.php By signing this document, you have read and understood this agreement in its entirety. You understand you may be asked to vacate the premises at the discretion of the Beach1.com Management Team or for violation of any of the terms set forth in this agreement. All sales are final. There are No Refunds (Security Deposit is the exception). By signing this document you also agree that if there are damages or losses exceeding the amount of the security deposit, that you will be held personally responsible for any replacements, repairs, labor costs associated with the damaged/lost items occurring from the dates you were on the premises. * By signing this agreement you understand this contract to be a binding agreement governed under the laws of the Province of Ontario and agree to adorn solely to the Jurisdiction of the courts of Ontario with Respect to any and all disputes arising out of the interpretation and application of this agreement between the renter and the owner / staff.
